Policies on export and import of goods, medical equipment and support tools for COVID-19 prevention and treatment

The General Department of Customs has issued document directing custom procedures for export and import of goods, medical equipment and support tools for COVID-19 prevention and treatment.

Under the provisions of Resolution No. 20 / NQ-CP dated February 28, 2020, Viet Nam applies the export licensing regime for medical masks in the stage of preventing and controlling COVID-19 epidemic and only allows the export of medical masks for the purpose of humanitarian aid or international assistance implemented by the Vietnamese Government (up to 25% of output for export, 75% of output for domestic usage).

Accordingly, the General Department of Customs directs provincial, municipal Customs Departments to only handle procedures for exporting medical masks as prescribed at Point 1 of Resolution No. 20 / NQ-CP in the following cases:

- Enterprises licensed by the Ministry of Health to export masks for humanitarian aid or international assistance purposes provided by the Vietnamese Government;

- Export processing enterprises with business investment certificates granted by competent agencies to conduct processing contracts with foreign countries signed before March 1, 2020. According to the regulations, the processing contract must be notified to the customs authorities before March 1, 2020.

The Customs units shall conduct physical inspection of export goods declared as non-medical masks, compare with the standards of medical masks TCVN83 89-2010 published by the Ministry of Science and Technology to determine the actual goods. Through physical inspection, if the customs officers have insufficient information that the goods are classified non-medical masks, they will solicit expert assessment at the Institute of Medical Equipment and Works (the Ministry of Health) or legal inspection organizations that fully meet the conditions for medical mask examination to determine the category of the inspected goods.

Customs Departments of provinces and cities shall direct border-gate Customs Sub-Departments and Customs control forces to intensify the inspection, control and handle the acts of smuggling or illegal transportation of medical masks cross the border. At the same time, they also direct Customs Sub-Departments and customs control forces to monitor the exportation of equipment, protective gear, clothing and gloves for medical use. In case there is a sudden increase in the quantity of exported goods, they must summarize the data and report the total export amount of medical marks to General Department of Customs to synthesize the situation and propose competent authorities to have appropriate management measures.

In addition, the General Department of Customs requires Customs units to facilitate customs clearance of imported goods, machinery, medical equipment, preparations, disinfectant solution, pharmaceuticals and support tools serving the prevention and treatment of COVID-19. The General Department also requires its officials and public employees who directly contact with the customs declarers, goods, luggage and transport vehicles to wear standard masks and gloves as recommended by the Ministry of Health. At the same time, it is recommended that customs officers who contact with people identified as infected with COVID-19 or those who are suspected of being infected or exposed shall notify the local health authorities, take appropriate isolation measures and are allowed to work at home, without affecting the health of other officials and public employees.
