Tariff for implementation of the CPTPP

​The Government recently issued Decree No. 57/2019 / ND-CP dated 16 June 2019, on Vietnam's Preferential Export Tariff and Special Preferential Import Tariff to implement its commitments under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) in the period 2019-2022


The decree is applicable to Mexico, Japan, Singapore, New Zealand, Canada and Australia, where the CPTPP Agreement has come into effect.
Tariff Schedules on Preferential Export Duties under CPTPP Agreement are set out in Appendix I to this Decree, including: Commodity codes, description and preferential export duty rates applied to commodity codes over periods for exports to specific member states, provided in Point a, Clause 4, Article 4 in this Decree.
United Mexican States applies duty rates specified in Appendix I:
+ From January 14, 2019 to December 31, 2019 at the column bearing the symbol “(I)”.
+ From January 1, 2020 to December 31, 2019 at the column bearing the symbol “(II)”.
+ From January 1, 2021 to December 31, 2021 at the column bearing the symbol “(III)”.
+ From January 1, 2022 to December 31, 2022 at the column bearing the symbol “(IV)”.
 
Australia, Canada, Japan, New Zealand and Singapore Republic apply duty rates specified in Appendix I:
+ From January 14, 2019 to December 31, 2019 at the column bearing the symbol “(II)”.
+ From January 1, 2020 to December 31, 2020 at the column bearing the symbol “(III)”.
+ From January 1, 2021 to December 31, 2021 at the column bearing the symbol “(IV)”.
+ From January 1, 2022 to December 31, 2022 at the column bearing the symbol “(V)”.


To be eligible for preferential export duty rates under the CPTPP, goods must be accompanied with transport documents and import declarations showing the destination lying within the territories of the above countries. In case of failure to submit these documents, ordinary duty rates would apply.
The decree also states that customs declarations registered from January 14, 2019 to date, if all conditions are met, will receive overpaid tax from the customs office according to regulations.
