From 01 to 09 March 2017, the e-Customs Portal has been updated with documents related to commodity classification, tax policy, customs valuation, goods management policy.
Regarding to classification of goods
On 06 March 2018, the General Department of Customs issued the official letter no.1187 /TCHQ-TXNK guiding the classification of led lamps. Accordingly, base on the guidelines for classification, the led lamp in plate size 600x600mm, 48W, model 6060AP4860A-A0 (composition: chassis, power connector, rectifier, light-emitting diodes (LED), hanging hooks, used for ceilings) is classified with HS code 9405.10.90.
The General Department of Customs has guided the classification and tax treatment for supplementary foods in liquid. Details are in the official letter no. 1140 /TCHQ-TXNK dated 05 March 2018.
About tax policy
On the issue of tax exemption for PVC cable guards to create fixed assets of investment incentive projects, the General Department of Customs issued the official letter no. 1154/TCHQ-TXNK dated 05 March 2018, guiding to compare the imported items, the approved tax exemption list and other relevant dossiers for tax exemption, in addition, to review the actual use of these tax exempted goods. If detecting violations, tax arrears shall be collected and handled according to regulations.
On 03 Feb 2018, the Ministry of Industry and Trade issued the Decision no. 686 /QD-BCT apply official safeguard measures for and MAP fertilizers with HS code: 3105.10.20; 3105.10.90; 3105.20.00; 3105.30.00; 3105.40.00; 3105.51.00; 3105.59.00; 3105.90.00 imported into Vietnam from different countries/regions with the details stated in the notice enclosed with the Decision.
The Ministry of Industry and Trade sent the official letter no. 1682/BCT-PVTM dated 05 March 2018 to the Ministry of Finance and the General Department of Customs to announce the self-defense tariffs applied to DAP and MAP products in each period.
The General Department of Customs also sent the document no.1218/TCHQ-TXNK dated 07 March 2018 guiding the reimbursement of tax for items exported instead of being sold in the domestics as declared before. Basing on the guiding documents and specific cases, the companies shall be refunded the paid import tax according to regulations.
On 07 March 2018, the General Department of Customs issued an official letter no.1208/TCHQ-GSQL on the request not to collect the special consumption tax on four lots of alcohol which were imported for processing and producing goods for export used on departing aircraft.
On customs valuation
On handling customs value, the General Department of Customs issued the official letter no.1158/TCHQ-TXNK dated 05 March 2018. Accordingly, the General Department of Customs explained in detail for the enquiries of EuroCham on notice of suspicion, customs value and database for customs valuation.
On the policy of customs and specialized management
On 06 March 2018, the General Department of Customs sent the official letter no.1172 /TCHQ-GSQL to the Ministry of Information and Communications to handle the petition of export processing enterprise that hiring domestic enterprises to repair one part of products for foreign partners.
On 06 March 2018, the General Department of Customs issued the official letter no.1173/TCHQ-GSQL dated 06 March 2018, requesting the General Department of Fisheries (the Ministry of Agriculture and Rural Development) to provide specific guidance on the policy for goods in Appendix no. 16 issued enclosed with Circular no.24/2017/TT-BNTPTNT in general and for hooks, fishing rods in particular.
On 01 March 2018, the Prime Minister signed the Decision no.10/2018/QD-TTg amending and supplementing some articles of Decision No. 53/2013/QD-TTg dated 18 Sep 2013 on the temporary import, re-export, destruction or transfer of automobiles and motorbikes of subjects enjoying privileges and immunities in Vietnam. The decision takes effect from 20 April 2018. In addition, the Customs Portal also updates some of the following documents:
- Circular no. 01/2018 / TT-BCT dated 27 Feb 2018 regulating details of goods traded, exchanged through sub-border gates or opened border gates.This Circular takes effect from the singing date.
- Circular no. 02/2018 TT-BTC detailing the list of goods traded, exchanged by border residents, effective from the date of issuance.
- Decree no. 12/2018/ND-CP dated 23 January 2015, amending and supplementing a number of articles of Decree no.01/2015/ND-CP detailing the scope of customs operation areas; to cooperate in the prevention and combat of trafficking and illegal cross-border transportation. This Decree takes effect on 10 March 2018.
- Official Letter no.1228/TCHQ-TXNK dated 08 March 2018 in reply for the problems faced by the Dong Nai Customs Department on declaring VAT on VNACCS/VCIS system.
