Tax issues
The General Department of Vietnam Customs (GDVC) issued the official Letter no. 5002/TCHQ-TXNK dated 27 July 2017, guiding on import duty rate and VAT for importing Singapore used ships for oil and chemicals transport.
On proposal of an enterprise and Ho Chi Minh Customs Department’s report, The General Department of Vietnam Customs issued the official Letter no. 5112/TCHQ-TXNK dated 02 Aug 2017 for guidance on VAT refund due to mistake payment.
On 31 July 2017, Ministry of Finance promulgated official Letter no. 10146/BTC-CST, guiding import tax preference policy for BOT of Hai Duong power plants.
The General Department of Customs sent the official Letter no. 4999/THCQ-TXNK dated 27 July 2017 to an enterprise which clearly identify that export tax exemption is not applied for the commodities with HS code 7601.20.00, 7604.29.10 and 7604.29.90 imported to produce exported goods.
Regarding to the customs value of exported goods, the General Department of Customs states that the customs value is the selling price of such goods item determined upon its arrival at the border gate of exportation excluding insurance cost (I) and international freight charge (F). Details are as per in the official Letter No. 2831/TXNK-TGHQ dated 28 July 2017.
On 31 July 2017, the General Department of Customs issued the Decision no. 2596/QD-TCHQ, amending and supplementing Decision No. 384/QD-TCHQ dated 04 March 2017 on the regulation of information exchange on customs declaration, collection of tax, late payment, fines, charges, fees, others, tax guarantee for exported and imported goods, collection of charges, fees and others of the management agencies through the electronic payment gateway of the General Department of Customs.
On 28 July 2017, the General Department of Customs sent the official Letter No.5010/TCHQ-GSQL to Dong Nai Customs Department and Lang Son Customs Department to guide the test of minimum energy performance standards.
Classification of goods
On 28 July 2017, the General Department of Customs issued the official Letter No. 5019/TCHQ-TXNK guiding the classification of "coffee grinder".
The General Department of Customs also issued official Letter no. 5100/TCHQ-TXNK dated 02 Aug 2017 to respond to an enterprise on the classification of goods for special purpose trailers. Accordingly, trailers are specified in heading 87.16 - Trailers and semi-trailers; other vehicles, not mechanically propelled; parts thereof.
Regarding to classification of commodity "Hyd Crane" and related policies, the General Department of Customs issued official Letter No. 5017/TCHQ-TXNK dated 28 July 2017. On 02 Aug 2017, the General Department of Customs issued the official Letter No.5101/TCHQ-TXNK to re-confirm classification result as per the announcement no.1224/TB-TCHQ dated 01 March 2017 on the imported electric wire and cable products. At the same time, the General Department of Customs also provides guidance on the deadline for submission of certificates of origin (C/O) in order to enjoy special preferential rates.
